Charleston, WV: A class action lawsuit has been filed by Esther Viola Abrams, against JC Penney Credit Services, General Electric Company, and NCO Financial Systems Inc, alleging that the defendants illegally substituted herself as the debtor on her deceased husband's credit card without her consent, instead of making a proper claim against his estate. The suit is filed on behalf of all others similarly situated.
Specifically, the suit states that the defendants repeatedly harassed Mrs. Abrams to collect the false debt, and falsely reported her to a credit reporting agency stating that she refused to pay a just debt. Consequently, the defendants damaged Mrs. Abrams credit rating. And she further alleges suffering embarrassment, anger and humiliation as a consequence of the actions of the defendants.
The proposed class action seeks damages and civil penalties for each violation by the defendants in addition to lawyers' fees and costs of litigation, and any other relief the Court deems just.
