Santa Clara, CA: A consumer fraud class action lawsuit has been filed against the software company that owns Turbo Tax, alleging some of the terms and conditions of use for the program are illegal.
Specifically, Aaron Rubin and Fay Rubin, individually and for all others similarly situated, are claiming the terms and conditions for Intuit's Turbo Tax program intentionally attempts to absolve Intuit of all possible liability, blatantly obscures the effects of their disclaimers on New Jersey residents, and neglects or ignores duties Intuit owes consumers.
Filed in New Jersey, the lawsuit claims violations of New Jersey's Truth-in-Consumer Contract, Warranty and Notice Act.
The plaintiffs are seeking a minimum $100 per class member for each violation, injunctive relief, attorney fees and costs. They are represented by attorney Fred M. Zemel of The Zemel Law Firm in Newark, New Jersey. The case is US District Court for the District of New Jersey Case number 3:16-CV-02029-FLW-LHG.

I filed early with Turbo Tax and I always purchase the Tax max Incase I need help after filing. No where did it say if I filed before the 29th I would get and automatic reject and code REJ002. Now they want me to pay to refile and that means they r getting double payment. It’s a SCAM and it needs to be reported and something done. Taxes are stressful enough and then you add this to it and it’s so unfair...

I had Turbo Tax Intuit and had to pay fees now my credit report has items that do not know where it came from pertaining to filing. In addition, paid for attorney fees Time to get the AG in TX involved, truth in lending, and fraud, not stating you are selling records as Experian was busted for 3 years ago

I have used Turbo Tax and it's Audit Defense for years. I did not know the fraud calls, sales calls and junk mail had anything to do with them before either.
Moreover, it looks like Audit Defense's performance is dependent on the auditor your assigned. In 2011, it's rep was super good, told me not to worry and really went all out with the IRS. Then 2013, had to scan 100s of docs to send it's auditor, rarely returned calls or emails, and would fight for mileage to the drug stores, as felt it was not a lot of money involved. I am still fighting IRS on this and had to file my own "abatement" request too. Hit with penalty and interest for first time in my 73 years. Now have asked them to appeal, denial of abatement and drug store trips to tax court, also denied all cash contributions, and miscellaneous deductions too. Moreover, why do we only get 26 cents a mile for medical trips, but 56 cents a mile for business trips.
