A lawsuit has been filed and is seeking class action status against major oil companies and several retailers for allegedly selling 'hot gas', warmer than the industry standard of 60 degrees, which gives less energy per gallon. The case seeks to represent consumers in California, Arizona, Texas, Florida, North Carolina, New Jersey and Virginia. The suit was filed in US District Court in San Francisco and is asking the court to require retailers to install temperature correction equipment on their retail pumps or post notices of the temperature of the fuel being sold. The class action lawsuit charges the petroleum retailers with breach of sales contract and consumer fraud. The seventeen companies charged in the suit are Alon, Ambest, Chevron, Circle K, Citgo Petroleum, ConocoPhilips, Costco Wholesale, Flying J., Inc., Petro Stopping Centers, Pilot Travel Centers, 7- Eleven, Shell Oil Products, Tesoro Refining and Marketing, The Kroger Company, Travel Centers of America, Valero Marketing and Supply, and Wal-Mart Stores.
