A class action lawsuit has been filed by 2 waitresses who work at a Hooters restaurant in New York, alleging that Hooters failed to reimburse them for buying and cleaning their uniforms.
The uniforms consist of lycra hot pants, a tight tank top, white socks and suntan pantyhose, totals $20.00. Under New York state labor law an employer must provide its workers with a workplace uniform if the company stipulates that employees are not to wear regular street clothing, or the uniform is not considered part of regular street clothing.
At least 100 waitresses who worked at Hooters in Islandia, East Meadow and Fresh Meadows could qualify a plaintiffs in the suit.
