Los Angeles, CA: A class action lawsuit has been file against Consolidated World Travel by a California resident alleging violations of the Telephone Consumer protection Act (TCPA). Also known as Holiday Cruise Line, the company is accused of sending unsolicited advertising emails and text messages to the plaintiff' cell phone, actions which are banned by the TCPA.
According to lawsuit, plaintiff Scott Wiederhold received 15 messages starting in December. The messages claimed that Wiederhold has prizes to claim, despite his never having any kind of relationship with the company. He called the company to find out more and since that time he has been receiving emails to solicit his business.
The lawsuit seeks to represent all people who received a text message from the company without prior express consent, using an auto dialing system, within four years leading up to the complaint.
Wiederhold brought one count of negligent violation of the TCPA, asking for $500 per violation per class member. He also brought one count of willful violation, which would carry an award of $1,500 for each violation.
