A lawsuit has been filed and is seeking class action status against the town alleging illegal business licensing practices that unfairly discriminate against certain companies. The lawsuit claims Hilton Head Island is unconstitutionally taxing companies that conduct business across state lines and that business have been charged business license fees that should be exempt under the Commerce Clause of the U.S. Constitution, which says that only the federal government can regulate interstate commerce.
