Los Angeles, CA: An antitrust lawsuit has been filed in Louisiana state court by Louisiana Attorney General James Caldwell, alleging the GlaxoSmithKline (GSK) maker of Flonase, deliberately attempted to keep generic versions of the nasal spray from entering the market.
In the lawsuit, the AG alleges GSK employed a so-called "brand maturation strategy"designed to prevent or delay a less expensive generic version of Flonase, or fluticasone propionate, from entering the consumer marketplace. The lawsuit states that GSK employed four tactics to achieve their goal: specifically, Improperly influencing the Food and Drug Administration' bioequivalence guidance process; Filing successive objectively and subjectively "baseless"citizen petitions with the FDA; Drafting a fluticasone propionate monograph for submission to the U.S. Pharmacopeia, which lists test, procedures and acceptance criteria in order to set standards for quality, purity, strength and consistency of the pharmaceutical ingredients in an approved drug; and Supplementing its original New Drug Application in an attempt to delay the FDA from approving any Abbreviated NDAs before approving GSK' supplements.
"As a result of its unlawful 'brand maturation' scheme to keep generic versions of Flonase off the market, and in violation of Louisiana antitrust and unfair competition laws, GSK: (a) illegally maintained monopoly power in the market for fluticasone propionate in the United States for at least 20 months and sold more than $1 billion of Flonase during that time; (b) maintained the price of Flonase at supra-competitive levels; and (c) overcharged Plaintiff millions of dollars by depriving it of the benefits of unrestricted competition and access to less expensive generic versions of fluticasone propionate,"the lawsuit states.
As a result of GSK' anticompetitive practices, the state of Louisiana has paid "unlawfully inflated prices"for Flonase.

Used it for 2 days and lost my sense of smell and taste and it hasn't come back. Initially all I could taste or smell was the smell or taste of burnt metal. Now I have no taste or smell. Devastating.. Reading thru the internet, their is a lot people that this has happened to.

WHILE SERVING IN THE ARM SERVICES I WAS CONTINUALLY HAVING SINUS ISSUES. THEY PRESCRIBED FLONASE WHICH I USED FOR AT LEAST 6 TO 7 YEARS . I ALWAYS THOUGHT THE LOST OF MY SENSE OF SMELL AND TASTE HAS TO DUE WITH NASAL CONGESTION UNTIL ONE OF DOCTORS ASK IF I COULD IDENTIFY SMELLS OR NOTICE IF FOOD TASTED DIFFERENTLY OR NO TASTE AT ALL. I WOULD LIKE TO HAVE THE SENSE OF SMELL BACK MAINLY TO IDENTIFY ELECTRICAL OR OTHER BURNING SMELLS , MILDEW , OR EVEN A GAS LEAK IN A HOUSE. TASTING FOOD WOULD BE GREAT TOO. SOME OF DOCTORS I'VE SEEN IN THE PAST TO PRESENT SAID I WOULD PROBABLY WILL NEVER GET IT BACK . SUCKS TO BE ME! SO I IF THIS COMPANY HAS SO MANY PEOPLE WITH LOSS OF SMELL AND TASTE, WHY IS THEY'RE NO CLASS ACTION LAW SUITS. I DEFINITELY WOULD LIKE TO HERE IF THERE EVER IS ONE!

I completely lost both my sense of smell and of taste after using Flonase a couple of years ago. I had a very acute sense of smell before, and now have only a very altered sense of smell on a very few things. It no longer bothers me to cut garlic. If I burn something in the kitchen, I don't know until my husband yells or I see smoke, etc.
