A lawsuit has been filed and is seeking class action status against the two dental car providers claiming thousands of children could lose dental care if the providers contracts are canceled. The complaint was filed in US District Court in Rome on behalf of 100,000 children in the state of Georgia.
The contracts are scheduled to be canceled Friday August 24, 2007. The lawsuit claims that if WellCare of Georgia and Peach State Health terminate contracts with Kool Smiles and Help a Child Smile, about 70,000 children could suffer. The case alleges that many dentists do not accept Medicaid and PeachCare insurance, so many children would effectively lose care.
The lawsuit also names Georgia Department of Community Health Commissioner Rhonda Medows as a defendant, claiming she is responsible for managing these programs and for the loss of these dental care providers.
