A certified class action lawsuit has been filed against the developer alleging defects in construction have caused mold, water damage, and disruption. The lawsuit was filed on behalf of 300 current and former tenants of the Gateway Apartments in Marin City. The lawsuit claims Gateway Apartment Partners rented the over 200 units knowing that they were defective while collecting rent and government subsidies. It alleges the substandard conditions endangered the health and safety of the residents.
Gateway claims to have spent over $10 million in repairs, and notes that tenants were offered relocation options during the repairs, but most chose to stay at a reduced rent. Gateway Apartments is a 12-building complex with 225 apartments built in the mid-1990s.
