Sacramento CA: Gap Inc, is facing a proposed nationwide unpaid overtime class action lawsuit filed by Tiffany Ino, who was employed by the Gap from April 2008 to April 2011 in the state of California.
Ino, the lead plaintiff in Tiffany Ino v. The Gap Inc., Case No. 3:14-cv-00292, in the US District Court for the Northern District of California, is alleging The Gap requires its employees to work off the clock which is in violation of California labor law and federal employment laws such as the Fair Labor Standards Act (FLSA).
Ino filed her overtime pay lawsuit in January of this year and seeks to represent any and all current or former employees, who worked for The Gap nationwide for a three-year period immediately preceding January 2014, (and possibly individuals who have worked for any of the Gap' subsidiary companies, including Old Navy, Banana Republic, Piperlime, Athleta and Intermix).
In her complaint, Ino alleges that the Gap "knew or should have known that [she and the proposed class] were entitled to receive certain wages for overtime compensation and that they were not receiving them." The lawsuit claims that Gap employees were required to remain on call without overtime pay or compensation, as well as for time spent undergoing bag checks for security, and assisting customers with various activities while employees were off the clock.
