Ford Focus and Fiesta Defective PowerShift Transmissions Class Action Lawsuit Filed

Santa Clara, CA: A defective automotive class action lawsuit has been filed against Ford Motor Co. alleging that Ford’s model year 2012-16 Focus and 2011-16 Fiesta sedans have defective PowerShift transmissions, a problem that has been ongoing for years.

The nearly 7,000 Fiesta and Focus are enrolled in the class action describe the problem as faulty dual-clutch transmissions prone to "shuddering, slipping, bucking, jerking, hesitation while changing gears, premature internal wear, delays in downshifting and, in some cases, sudden or delayed acceleration."

According to the complaint, Ford issued a technical service bulletin to dealers on January 1, 2011, which noted the Fiesta's PowerShift transmission could suffer "a loss of power, hesitation, surge, or lack of throttle response while driving." In total, Ford has issued more than 20 technical service bulletins relating to the affected models, but so far has been unable to find a "consistently reliable repair."

Then, in 2014, Ford extended its powertrain warranty from five years/60,000 miles to seven years/100,000 miles to help cover the problems.

According to lawyers representing the class, each client's award would be customized based on that client's damages.

I bought a 2013 Ford Fiesta from CarMax and of course they didn't tell me anything at all about the crummy transmission. I've had it in the dealer at least 5 times with major work on the transmission done 4 of those 5 times. It was all under manufacturers warranty so I wasn't out any money per se. The unfortunate part is we're retired and I can't afford a new car payment and I'm super gunshy about buying used again. I'm stuck with this car and even though it's running, it still sputters and delays. If I have to take a trip out of town, I always rent a car because I typically travel alone and don't want to be in the middle of nowhere with a broken down car. Would I qualify to join a class action suit due to unnecessary expenses in car rental and emotional stress?

I am a little confused. I need clarification.

I own a Ford Focus 2012 hatchback and the car has had transmission problems from day one. I bought this car pre-owned from a Ford dealership and I bought the 5 year warranty when I purchased it. In 2017 the transmission had to be replaced and fortunately it was still under the purchased warranty. However, the car is having issues again and I brought it into the dealership. We thought all the symptoms were caused by the recent fuel cap recall but after I brought it to Ford they said they did the recall and found a whole bunch of other issues with the front end and they charged me $3k. I brought the car home and immediately I realized that the car continued to have the engine problems I had taken the car in for and contacted the Ford department manager to inform him. He said bring the car in and we will fix it the same day. Well, I waited 3 days and then I was told that it was the transmission control module and now they want $2300 more to fix. If they had told us I had to spend over $5K to begin with, I would have said "hell no", it's not worth it.. But now I have invested $3K into this old car, and after reading about other customers and all the issues with transmission control modules and all the issues that persist, I am taken back and don't even want to spend more money.

Can I still join the action lawsuit (I was just reading about it)? And if so, how do I go about it? I have not spent the money yet but the car is malfunctioning and if I don't get it fixed I will have to junk it eventually. Can you please help?

I bought my car brand new in 2014 Ford fiesta they had to keep my car for almost a month because they said they had to order apart then when I got it back I found out they had just recalibrated it and I'm still having the same problems and I have less than 21,000 miles on my car are you taking it in three times they keep telling me they don't hear however when you push the gas it's sputters and won't going to gear you can feel it. I'm going to try again in a few weeks to take it back and see if they will look at it again . Something is definitely wrong with my transmission but they're telling me it's not .

I have a 2012 Ford focus an it has now started to shudder when shifting gears I called Ford an they won't do anything cause my car has over 100,000 miles on it. What do I need to do?

I purchased a NEW 2016 Ford Fiesta Hatchback in September 2016.. At that time this Ford dealer knew or should have known about this transmission issue & informed me 'before' taking my down payment & having me sign on the dotted line for a loan so that I could make a prudent decision "to buy or not to buy".. The dealer did not inform me of this issue & 2 months after I made the purchase I started to notice the jerking, lunging etc when the transmission tried to shift gears.. I'm not Mario Andretti but I've owned/leased enough new cars to know when something is not working right.. Went to the dealer they said "they could not recreate the issue & that I should come back when it happened again" HUH the transmission does not give advance notice.. I filed several complaints on the transmission & the tilt/telescopic wheel adjustment lever to NHTSA.. Received my notice for the Class Action Settlement last week..

MY 2016 FORD FOCUS HAS HAD 3 NEW CLUTCHES AND NOW ANOTHER ONE WILL BE IN SOON . CANT GET THEM TO TAKE THE CAR BACK WITH OUT MAKING MY PAYMENT 200.00 DOLLARS MORE THAN IT IS NOW VERY UNFAIR OF FORD TO NOT TAKE THE CAR BACK AND MAKE GOOD ON THE JUNKIE POWER DRIVE
