A class action lawsuit has been filed against six businesses, a government agency and one man in reference to the September 2003 flood that caused damage in the city of Jermyn, Pennsylvania. The defendants in the suit are Theta Land Corp. of Wilkes-Barre; Keystone Sanitary Landfill of Dunmore; Pennsylvania American Water Co. of Hershey; Southern Union Co. of Wilkes-Barre; Deer Park Lumber, Inc. of Tunkhannock; timber concern Jaflo Inc. of Allentown; the Pennsylvania Department of Transportation; and Louis DeNaples of Dunmore.
The suit alleged that timber was cut down and left lying about in the Rushbrook Creek watershed, and subsequently washed into the creek forming timber dams. These dams built up and then burst, causing an estimated $5.5 million dollars in damages.
