A lawsuit has been filed and is seeking class action status against the masseur who allegedly filmed female clients while they undressed. Richard Allan "Rico" Filbin allegedly set up hidden cameras in both his home and business, Body and Soul Massage Therapy in Cross Lanes, to surreptitiously record women as they disrobed. The suit accuses Filbin of invasion of privacy and intentional infliction of emotional distress and negligence.
The lawsuit was filed in Kanawha Circuit Court and claims Filbin filmed individuals while they were dressing, undressing, and receiving massage therapy treatments without consent or knowledge.
Filbin, 52, of St. Albans, was arrested and charged with 114 counts of criminal invasion of privacy. Police have estimated that there are at least 50 women who were secretly filmed by Filbin between 2001 and 2006.
