Class action status is being sought in a lawsuit filed against fax.com and Drug Valet Inc. on behalf of unsolicited fax recipients in Pennsylvania. The suit alleges that under the Telephone Consumer Protection Act, the Federal Communications Commission imposes stringent rules which make it unlawful to "use a telephone facsimile machine, computer, or other device to send an unsolicited advertisement to a telephone facsimile machine." The suit claims that the plaintiffs did not give the company permission to send bulk faxes to their machines, and that under the Act, each violation could be punishable by a $500 fine.
