National Employee Collective and Class Action Lawsuit Filed Against CVS

Roslyn, NY: A lawsuit has been filed in on behalf of a class of current and former CVS employees alleging violations of the Fair Labor Standards Act and New York State labor laws.

The lawsuit contends that employees at CVS stores are subjected to off-the-clock security checks at the end of each shift which can take up to 30 minutes. It also accuses the Rhode Island based company of forcing employees to work through meal and rest breaks without compensation and of failing to pay overtime wages.

The suit alleges that after clocking out, employees are required to wait for a manager to be paged and then submit to a search of their person and personal belongings. The suit also maintains that employees are not paid overtime wages and are routinely required to work during paid meal and/or rest breaks and after they clock out.

I signed a waiver from required lunch breaks (must take a 1/2 hr. lunch break if working 6 or more hrs.) I was a PT Cashier. I do not require any breaks. I don't smoke, I don't drink coffee, and I don't eat McDonalds food, which is about the only thing one can get in 30 mins. Not required to stay, but required to punch out. Not interested in sitting in my car or the break room watching the clock pass 30 mins. It is a Cost Center Mgt. device. Asked to be scheduled for no more than 5 1/2 hrs. shifts. Again I was PT. What is the point of signing a waiver. I was written up for refusing to take a Lunch break, after signing the waiver. I refused to sign the Mgrs. write up as I did not agree with it. I was then terminated!
