A lawsuit has been filed and is seeking class action status against the resort for allegedly depriving food service employees of tips and wages. The lawsuit was filed in Berkshire Superior Court on behalf of current and former food and beverage employees. The lawsuit claims Cranwell has only distributed portions of cash tips, taxes, and gratuities.
The resort charges a 20% tax on top of the cost for reserving its banquet facilities for group functions; it also charges guests staying at the resort a dining gratuity for food and drink packages. The suit alleges Cranwell misleads its patrons into believing that it distributes all of these fees and cash tips to its food service staff as extra wages. Instead, the lawsuit alleges Cranwell has distributed only a portion of the 20% tax to its food service workers, and has kept the remaining portion for the House, or other employees.
The suit names as defendants Cranwell Management Corp., Berkshire-Cranwell Limited Partnership, C-B Management Corp. Daniel Burack, Allen Movsesian, Peter Burack, Kevin Kloc, and Lewis Kiesler.
