A class action lawsuit has been filed claiming the utility was negligent in allowing power outages. The lawsuit was filed in Cook County Circuit Court and alleges ComEd failed to provide continuous, adequate, efficient and reliable power, failed to provide adequate warning prior to power outage, and failed to adequately maintain its facilities.
A storm hit the Chicago, IL area on August 23, 2007. Severe storms and at least one tornado tore through the Chicago area with winds of up to 80 mph and 3 inches of rain. Up to 700 ComEd crew members restored power to about 630,000 customers, including 90 percent within the first 48 hours.
The case claims customers suffered property damages, financial damages, adverse health consequences and other damages due to the black outs. It accuses ComEd of breach of contract for failing to provide power per its agreement with its customers.
