Seeking class action status, a case has been filed alleging that overloaded coal trucks are both a private and public nuisance. The suit is asking for an injunction to block hauling of illegal loads and for damages to compensate the plaintiffs and punish the coal companies.
The suit claims that the overloaded trucks cause noise, dust and mud on local roads and homes, destruction of roads and bridges, increased risk of injury or death for other drivers, increased motor vehicle insurance, and reduced property values.
