A lawsuit has been filed and is seeking class action status against the convenience store chain for allegedly failing to pay overtime to managers. The lawsuit was filed in US District Court in Sioux City, Iowa and alleges Casey's General Stores violated federal law by avoiding paying overtime.
The suit seeks to compensate current and former employees who worked as assistant managers during a three-year period prior to filing.
The lawsuit claims the assistant managers were paid an hourly rate and were nonexempt under federal law, meaning they should be paid overtime. Assistant manager duties included cooking and packaging food, cleaning the store, working the cash register, and providing customer service.
Iowa-based Casey's General Stores runs 1,463 stores in Iowa, Illinois, Indiana, Kansas, Minnesota, Missouri, Nebraska, South Dakota, and Wisconsin. All but 15 franchise stores are company owned.
