Class action status is being sought in a California lawsuit filed against AT&T Wireless Services, Inc. The complaint alleges that AT&T sold "premium" Sony Ericsson T68i phones for $300 to $500, advertising them as "World Phones" because they could make and receive calls in the United States, Mexico, Europe, and other countries, and contained other advanced technologies.
After selling thousands of these phones, AT&T modified their system which substantially degraded service to users of these phones, and sent "free" replacement phones, informing customers that it was an "upgrade" when in fact it did not contain many of the features originally available on the "premium" phone. The suit claims that AT&T wrongfully and unfairly deceived its customers by advertising and selling these phones with "the implied promise that the product would be supported for a reasonable time" when it fact it was not and customers were forced to pay an additional $300 to $500 to again purchase a comparable phone.
