AT&T Faces Class Action over Excessive Data Usage Charges

Los Angeles, CA: AT&T is facing a potential class action lawsuit over allegations made by the Guardian Corporation and two private citizens of deceptive billing practices.

The suit claims that AT&T purposely inflated data usage numbers for customers with cell phones or smart phones, and subsequently overbilled clients for data usage, as much as three to five times more than what was actually used. According to the plaintiffs, this is done in such a way that it is hidden from the customer, and is impossible for the customer to identify without the help of an expert, and access to internal AT&T data reports.

The suit further claims that this practice is "a high-tech version of a gas pump meter that incorrectly measures the gallons of gas being pumped and then applies the per gallon charge to the fraudulent measure of gas, so that the consumer pays more than is proper."

The overcharging reportedly came to light when Guardian Corp noticed excessively high data usage rates and began working with AT&T to try and determine the cause. During the course of the investigation, the company discovered that its data usage rates were "being misrepresented by AT&T's system."

The plaintiffs are seeking restitution of the excess charges for all class members. Because the suit was filed in California, it applies to California AT&T customers. However, it is possible that this practice is ongoing in other states.

I think they are doing this to me my phone bill is always inflated. I even raised my data limit to 15 gigabyte but they claim even then it went over. I received one bill was like 600 dollars. I've been with att for 10 years just wondering how much they stole from me

The same thing is happening to me. I have two phones that are doing this and they aren't doing anything different than they were 6 months ago and we weren't going over our data plan. I have spoken to AT&T customer service and AT&T technical support. Nothing has been done to let me know what it is or how I can stop it from happening when my 15 Gigs should be more than enough data. But my usage was in the area of 25-26 gigs per month. At $15 per 1 gig that I go over my 15 Gig plan that's a boat load of money that AT&T is getting from me when they shouldn't be!!!

For over a year now AT&T has said I've been going over my data plan and that I should add more data so I did it was to the point when we werent even on our phones we would be sleeping at night the phones would go over the data and they would charge me $15 per one gig and in the last four months it seems like every 10 minutes it's saying we're going over our data plan and it's charging us $15.
