New York, NY: New York pizza chain 2 Bros if facing a
New York labor law and unpaid overtime class action lawsuit filed by employees who allege they were paid minimum wage or less with no overtime for workweeks of 60 or 70 hours.
The plaintiffs allege that the reason the pizza is so inexpensive is because the employees are paid a flat rate no matter how many hours they work. Longtime employee, Ruben Aca, alleges he worked 72 hours a week at 2 Bros Lexington Avenue location, but was paid a flat rate of $480 a week, or $6.66 an hour, for two years. According to the lawsuit, Aca received a raise to $600 a week in 2014, however he still works 60 hours per week.
Gabriel Bailon, who worked as a piemaker and cashier at 2 Bros flagship eatery on St. Marks Place claims he and other employees had their hours cut this year but so was their pay. Bailon, claims he typically worked from 11 in the morning until 11 or 12 at night, six days a week.
The plaintiffs are seeking back pay for hundreds of the chain' workers who it says have "not been paid minimum wage, overtime wages, spread of hours wages, (and) who had wages unlawfully deducted."
