Seattle, WASome states are filing lawsuits against companies that illegally charge restocking fees. Texas Attorney General Greg Abbott filed a lawsuit against ASAP Motors claiming the company illegally charged restocking fees. According to court documents the defendant charged a restocking fee of 20 percent on items that were delivered either damaged or defective despite a company policy stating that the restocking fee applied only to non-defective returns.
The lawsuit also alleges ASAP Motors is guilty of "Failing to disclose all terms of the sales agreement, or of any refund policy orally and in writing to each consumer prior to purchase, including the specific terms and conditions of refunds, returns, and restocking fees."
Last year the state of Washington reached a settlement with CompuVest, a company that sells computers via the Internet, after the company was accused of misrepresenting its return policies. Under the settlement CompuVest will pay over $20,000 to resolve customer complaints and an additional $50,000 in civil penalties. According to Attorney General Rob McKenna, CompuVest did notify customers that there was a 15 percent restocking fee on merchandise that is returned but not defective. However, the company did not inform customers that it would test returned items and charge the restocking fee and shipping fees for any products it deemed operable. The suit claimed that because of this practice customers were charged restocking fees on defective items.
Also last year Washington State filed a lawsuit against PeoplePeople, an online-based company that sells cheese, candles, and posters. The lawsuit alleged PeoplePeople violated the state Consumer Protection Act in a number of ways including charging a 15 percent restocking fee for returned orders regardless of why the item was returned. "Consumers who returned broken goods, wrong merchandise, or items shipped long after the promised delivery date were still charged a restocking fee," according to the attorney general's press release.

Once they get your info they keep it in the system and continue to charge me every month without my concent. And then want to charge for returning their products back to them.

I had the worst customer service experience with JustFab. They continued to charge my credit card for months after I had canceled my account with them. I did not ask to join any type of monthly club. Then when I called and demanded my money back they would not refund my account only 2-3 payments. I lost a lot of money due their company. Customer service was rude and very condescending. I had to call my credit company and out a stop to them charging my credit card.

I ordered a pair of boots for $20. After learning that I had to "pass" each month or my card would be drafted, I thought that is what I was doing. But, I was drafted twice (after passing) which sent my account in the negative. So I called, requesting to cancel this account. I was given the run around by a Chinese speaking female after I told her my issue. I became frustrated due to the language barrier. I ended up not cancelling, but making sure I "passed" the next month. Later on in the month, I tried again to cancel, but again, given the spill on why I should stay a member. It took me THREE separate calls on THREE separate occasions to finally have this account cancelled. I wrote a status on my FB page about this incident. Some of my FB friends also had problems

I was with Just Fab and my reason for leaving is that when i tried to to cancel my subscription , the system would not allow me to cancel and funds were taken just out of my account , in order to get out of the program , i had to get a new card to prevent them from taking funds out of my account.

I order a pair of boots off justfab.com didn't realize I become a VIP member not by choice and they took $40 dollar out of my checking account without my knowledge for eleven months I only recovered a hundred and seventy eight dollars. They told me the rest will be credit I told them that was bullshit you just can't keep my money.

I was had membership and bought shoes and referred customers for credit. When it was time to used my credit on a shoe the system locked me out. After I tried going in again it said my credit was spent. Try calling customer service never could get thru, so I lost my credit. I was disappointed with the site and never bought anything again.

I was a member of both shoedazzle and justfab and they both did the same thing. I did not sign up for the vip on either sites I did order and pay for shoes and a few months after that I noticed that the both companies had charged my account, when I tried to get my money back they said I had to order shoes. I never got my money back.

I was a member of justfab.com until they took money out of my bank account with out notifying me that would do this (I honestly do not remember giving the right to pull monies from my account even if I did not order anything). This put my account in overdraft. Costing me overdraft fees. Needless to say I called them and cancelled my membership. I don't think I asked for the VIP program, either. Thank you, Dorothy

I was charged a restocking fee on shoes that had to be returned due to them not fitting and then they charged my account even after I cancelled my membership, it took almost a month for my card to be reimbursed.

I was charged a restocking fee for some shoes that were sent back that was very poor quality. I closed my account after the second time that my account was charged without my knowledge, without being a VIP member. It then took over a month for them to close my account.

I went to check out shoedazzle.com and see what the hype was all about. I saw a pair of shoes that i really liked when i saw the regular price and the "sale price" i said wow!! it cant get better than that. So i bought the shoes, coming to find out i got that price because without my consent it automatically put me as a vip member!! they took money from my account twice and no where did it say that in order for me to get that price that i had to be a VIP member. They charged my card for a monthly fee twice and i had to close that account because i just did not trust that they wouldn't do it again. I called and told them that i would never shop there again and i never did.

I was with Just Fab for about one year, the shoes were substandard and when I wanted to cancel my membership it took about four months to end it. The re-stocking fees were ridiculous and an easy way for the company to make money. Let me know if the law suit goes forward.
