If a class action lawsuit settles, the court will hold fairness hearings to ensure the terms of the settlement are fair to all class members. There are usually two fairness hearings—the first is the "Preliminary Approval" hearing. After that hearing, a Notice of Proposed Settlement is sent out to class members. A Final Fairness Hearing follows at which class members can voice their opinions about the settlement. After that, a deadline is set for class members to submit claims.
