New York - In April 2005, the Norwegian Dawn cruise ship was hit by a rogue wave while sailing back to New York from the Caribbean. A group of passengers aboard the ship tried to file a class action lawsuit against Norwegian Cruise Lines claiming that despite rough weather, the ship was trying to make it back to New York for a television taping. The National Transportation Safety Board and the Bahamas Maritime Authority found no wrongdoing by either Norwegian Cruise Lines or Norwegian Dawn's Captain. US District Court Judge Ceciolia Altonaga denied the passengers their motion for class certification. (Sep-12-06)

I just came back from a back to back cruises departing from Buenos Aires on Feb 3rd and arriving in Miami on March 5th. During the trip NCL did some planned works on the ship creating loud noises and limiting access to deck 12 and other public area on the boat. The company policy is not to communicate in advance the work that they are planning to do during the cruises. Therefore I think that they are signing contract with customers knowing that they will fail to deliver...I would not have selected this cruises with proper knowledge of the work the company planned to do. The cruise was not quiet and we missed access to Observatory Lounge during the passage in the Chili's fjords. I asked for full reimbursment and was offer 500$ on board credit on a cruise to be taken within 12 months. This is unacceptable.
