Fort Lauderdale, FL: Zillow is facing a Telephone Consumer Protection Act (TCPA) class action lawsuit. Filed by a Florida real estate sales associate, the class action claims Plaintiff Bonnie Metviner has received "multiple"automated telemarketing calls from Zillow or a company working on its behalf, on a cell phone number that is listed on the National Do Not Call Registry.
Metviner has filed the lawsuit on behalf of herself and possibly "hundreds, if not thousands"of other Florida agents who might also have received unauthorized calls in the last four years.
In their complaint, attorneys for Metviner state that while her telephone number "may appear in certain publicly available materials, in relation to certain properties or offerings,"she did not consent to being contacted by Zillow or its representatives.
The complaint seeks an injunction prohibiting Zillow or its agents from engaging in "unsolicited telemarketing in violation"of the Telephone Consumer Protection Act, and statutory damages. Metviner is represented by Gabriel F. Zambrano, Gary Farmer, Steven Jaffe, Matt Weissing, Brad Edwards, Mark Fistos and Seth M. Lehrman of Farmer, Jaffe, Weissing, Edwards, Fistos & Lehrman, P.L.
