GoDaddy Facing Telephone Consumer Protection Act Class Action Lawsuit

Santa Clara, CA: GoDaddy.com is facing a proposed harassment class action lawsuit over allegations it sent plaintiff Jason Bennett of Baldwin County, Alabama, more than five telephone calls reminding him that his service had expired.

According to the suit, filed individually and on behalf of all others similarly situated, GoDaddy.com made these calls without Bennett’s consent, in violation of the Telephone Consumer Protection Act (TCPA).

Bennett alleges the defendant made these telemarketing calls intentionally, willfully and/or knowingly, and not even for emergency purposes.

Bennett seeks a trial by jury, an order certifying this action to be a proper class action, $500 to $1,500 in statutory damages for each call that violated the TCPA, injunctive relief prohibiting such TCPA violations by the defendant in the future, and other relief to which the plaintiff and class members are entitled. He is represented by attorney John R. Cox of Spanish Fort, Alabama. The case is US District Court for the Southern District of Alabama Case number 1:16-cv-00291-N.

How about the fact that as soon as you register your business domain that you end up on a list they sell to loan providers? I get 2-3 calls a day from providers asking me if I need a small business loan. It is 100% harassment!!
