Debt Collection Agency Faces TCPA Class Action Lawsuit

Santa Clara, CA: A Telephone Consumer Protection Act (TCPA) class action lawsuit has been filed against Fiserv Inc. a debt collector, alleging violation of the TCAP statutes.

Filed by Jason Alan, of Los Angeles, individually and on behalf of all others similarly situated, the suit claims that in March 2015, Alan received calls on his cellular telephone, attempting to collect an alleged outstanding debt.

According to the complaint, the defendant continued to call Alan, despite being informed in writing and over the phone, not to contact him. Alan claims Fiserv made calls using an automatic telephone dialing system and/or artificial or prerecorded voice, in violation of the TCPA.

Alan is seeking judgment for statutory damages of $500 and treble damages up to $1,500, for each and every violation and all other relief that the court deems just and proper. He is represented by attorneys Todd M. Friedman, Meghan George and Adrian Bacon of Law Offices of Todd M. Friedman PC in Beverly Hills. The case is US District Court for the Central District of California Case number 2:16-cv-05479.

I get a lot of collector calls that have nothing to do with me, including collectors asking for information about people I don't even know. How do I find out if this is one of the debt collectors bothering me?
