Starbucks Iced Drinks Target of Consumer Fraud Class Action Lawsuit

Santa Clara, CA: Starbucks is facing a consumer fraud class action lawsuit alleging its cold drinks are almost half ice, not fluid, and therefore misrepresents the fluid ounces of its iced coffee and tea drinks.

Filed by lead plaintiff Stacey Pincus, the lawsuit claims that In 2014, shaken iced tea drinks were the most profitable menu addition of the year for Starbucks. Three sizes are available, Tall, Grande, Venti and Trenta, which correspond to 12, 16, 24 and 30 fluid ounces, respectively. These fluid ounce measurements are advertised in the store.

According to the 29-page complaint, "A Starbucks customer who orders a Venti cold drink receives only 14 fluid ounces of that drink , just over half the advertised amount, and just over half the amount for which they are paying." And, "In the iced coffee example, a Starbucks customer who orders and pays for a Venti iced coffee, expecting to receive 24 fluid ounces of iced coffee based on Starbucks' advertisement and marketing, will instead receive only about 14 fluid ounces of iced coffee."

"In essence, Starbucks is advertising the size of its cold drink cups on its menu, rather than the amount of fluid a customer will receive when they purchase a cold drink, and deceiving its customers in the process," the lawsuit states.

Pincus seeks to represent a class of all persons who purchased a cold drink from Starbucks in the last 10 years. She accuses Starbucks of breach of express warranty, breach of implied warrant of merchantability, negligent misrepresentation, unjust enrichment and fraud.

The class is represented by Steven Hart with Hart, McLaughlin & Eldridge in Chicago.

I THINK IT IS HILARIOUS ALL OF YOU SAYING THAT YOU WERE MAD WHEN YOU SAW THIS LAWSUIT BECAUSE YOU NOW KNOW YOU HAVE BEEN CHEATED ALSO...IT TAKES YOU READING ABOUT IT TO NOTICE THAT YOU HAD A LOT OF ICE IN YOUR COFFEE TOO???

I've been getting iced drinks from Starbucks since 2000..and paying a fortune for them! This really makes me mad!

I emailed starbucks about 2 years ago. I usually added 3-4 espresso shots in my drinks, most of which was pored out. they credited my account with $5.00. and , well , i am in on this one

It took her 10 years to notice? I sorry but... I don't know what to say. It took her that long!? And yes I agree that Starbucks is pricey and cold drinks should be a little cheaper buy the ounce.

I used to average three frappuccinos and several cups of decaf coffee per week. This is ridiculous, as I would finish the frappuccino long before I got home less than a mile away.I also started getting little headache (which is usual when I would accidentally drink any regular coffee). Finally, I quit buying the decaf when they told me that it was all of their DECAFS were Americano-meaning it was a shot of expresso watered down. including decaf frappuccino . Now I know where the headaches were coming from and Not only was I not drinking real decaf, but also I wasn't getting the correct amount of coffee that I was paying for.

That fraud are to older, Mc Donals doing a some with ice, who can believe one guy with store franchise make 2.000.000$ net profit, selling garbage food. Are one radical way stop all fraud, set out business for good.Be free enterprise are alike free fraud, see banks, get free money to 2% and later charge a customer with credit card 20, 25% interest, and when some one with fake card go to ATM and steal money from account like happening to me, I must wait if refund money, but a bank NO take any responsability and protect a customer. That are deep corrupt business in USA.

I've worked for starbucks and have been buying their products ever since they opened in Los Angeles. Is it possible that the lady didn't specify EXACTLY what she wanted. That was the selling point in frequenting this coffee shop. When I was in high school I would purposely ask for NO ICE because I just wanted sugar and milk. People came in all the time when I worked there and would ask for the most detailed absurd drinks and I would have to look for a special recipe card or if the recipe card didn't exist I would have to ask my co-workers how to make the special drink. I think someone is just mad at the store because they realized how much money they've been wasting buying coffee that they could have made themselves at a fraction of the cost. IT IS POSSIBLE TO ASK FOR NO ICE! I've done it, my friends have done it, this lady could have done it. If you want it made a special way all you have to do is ASK.

For the cost of drinks I purchased false advertising should be punished! They charged enough for their drinks!

It's not just the cold ones, the hot ones are not the real size either, ask for a large cappuccino you will get it almost 3/4 and that is with the foam, when the foam settles the cup of fluid is not even 1/2 of the amount

I drank Starbucks on a regular basis until I saw this lawsuit. I feel betrayed, and hurt that I have paid a lot of money on this ice coffee and I'm not getting what I paid for, and they are making money on deceiving us customers.
