Santa Clara, CA: A consumer fraud class action lawsuit has been filed against The Quaker Oats Company alleging its Maple and Brown Sugar Instant Oatmeal products don’t, in fact, contain maple syrup.
Filed by plaintiff Kevin Phung, for and on behalf of others similarly situated, the lawsuit claims that the company deliberately misleads consumers through prominent claims that maple is an ingredient in the products. “Maple is generally considered to be healthier and more nutritious than other sweetener options,” the lawsuit states. “Some reported benefits of maple include fifty-four antioxidants, and high levels of vitamins like riboflavin and minerals like zinc and manganese.”
The lawsuit asserts that Phung relied on the representation that the products contained maple, believing them to be true. Had he known they contained no maple, he would not have purchased the instant oatmeal.
The suit seeks to represent a Class of California consumers who purchased any of the following Quaker Oats products: Maple & Brown Sugar Instant Oatmeal (Classic Recipe), Maple & Brown Sugar High Fiber Instant Oatmeal, Maple & Brown Sugar Gluten Free Instant Oatmeal, Maple & Brown Sugar Lower Sugar Instant Oatmeal, Maple & Brown Sugar Weight Control Instant Oatmeal, and Maple & Brown Sugar Instant Oatmeal.

I would like to know why a wider suit isn't being pursued based upon the labeling of "100% Natural" now that Quaker Oatmeal is demonstrated to contain amounts of Monsanto's herbicide 'Roundup'.

Hmmm. Not very healthy if they use artificial sweeteners and/or flavors. I still have a bunch of Quaker instant oatmeal with a variety of flavors stocked up. I picked them because of what I thought was quality. Guess I was wrong.

I believe the maple flavoring is triggering allergic reactions, I personally cant eat the flavored oatmeal because of the reactions. I investigated the additive and it comes from fenugreek seeds , but fenugreek is actually a legume closely related to peanuts. I believe this case has broader implications.
