Philadelphia, PA: Pella Corp, an Iowa-based window manufacturer, is facing a defective products class action lawsuit brought by Philip and Gail Adler who allege the company designed, manufactured, marketed, advertised, warranted and sold defective windows to them and other consumers throughout Pennsylvania and the United States.
The lawsuit contends that when the couple purchased their Pella windows the windows had a design defect which allowed water to enter the area behind the product and result in premature wood rot and deterioration. As a consequence of this alleged design flaw, the homeowners had to spend money to fix damage to wooden window frames and other damaged property in their residence.
"The defect described herein reduces the effectiveness and performance of the Windows and renders them unable to perform the ordinary purposes for which they are sold,"the lawsuit states. The plaintiffs also allege the defendant knew that the windows were defective but took no action to inform purchasers or owners of the windows of the defects, recall the defective windows, or otherwise repair the windows that had already been purchased."Instead, Pella concealed this knowledge,"the lawsuit states.
The Adlers, who are the lead plaintiffs in the case, say they purchased the defective windows made by Pella through their contractor when the couple was remodeling their home. The defective products lawsuit accuses Pella of violating the Pennsylvania Unfair Trade Practices and Consumer Protection Law, of negligence, breach of warranty, fraudulent misrepresentation and fraudulent concealment.

My pella window also rotted and i was cheated now i have to teplace a nig 3 windo bay windo. Pella terrible

We replaced about 7-8 Windows about 6 years ago. 6 of which we replaced only to get rid of the grids to open the view to a beautiful view. On 4-5 of them the seal has leaked. They are triple pane and I think we paid around $9,000. I do not have access to my receipt right now. We are getting ready ro sell our house and will have replace them. We are on a very limited budget and do not have the income we had when we purchased the Windows. My husband is a disabled veteran and our son was diagnosed several months ago with schizophrenia. I called and called and they said they were coming to replace them, no one ever showed up.

We built a home in 1998 and used the Pella pro line windows throughout. They were a huge portion of our building cost but I wanted to have quality that would be there when we decided to sell our home. Shortly after moving in I noticed problems with water on the sills and ice forming on the glass etc. I contacted Pella and was told this was condensation from new construction. Well 18 years later we are still experiencing that new construction condensation and have a large number of windows with black rotting sills to show for the great product Pella sells and doesn't stand by. We bought triple pane windows and you can still feel the air blow around them. Extremely dissatisfied and wish we would have been informed about a class action suit against Pella. Now we are left with deciding how to remedy the solution before we can put our house on the market.
