A class action lawsuit has been certified against Texas insurer National Foundation Life Insurance on behalf of Indiana policyholders. The suit charges the company with breach of contract, bad faith and violations of Indiana law, which states that insurers must cover pre-existing medical conditions unless the person received treatment for the condition in the six months before buying the policy or filed a claim for treatment of the condition within a year after buying the policy. The class includes affected policyholders who have filed claims over the past 10 years, and the suit is seeking compensation for unpaid medical claims.
