Class action status is being sought in a lawsuit filed against California Secretary of State Kevin Shelley and the registrars of voters in Los Angeles, Orange and San Diego counties on behalf of supporters of California Governor Gray Davis. The suit claims that the signatures on recall petitions were gathered illegally, and is seeking to challenge the recall process. The suit alleges that the recall proponents violated the law by using petition circulators who were not registered California voters and did not witness signatures being signed. The suit seeks and injunction to cease action on the recall until county elections officials verify that the people circulating recall petitions were registered California voters.
