Johnson & Johnson, Bristol-Myers Squibb Co., AstraZeneca Plc and GlaxoSmithKline Plc

Consumers have filed a nationwide class action suit against Johnson & Johnson, Bristol-Myers Squibb Co., AstraZeneca Plc and GlaxoSmithKline Plc claiming the drug makers artificially inflated prices. A judge ruled the plaintiffs were harmed by the way the companies charged for their drugs.

The drug companies might have to repay hundreds of millions of dollars if they are found to have over-charged. A consumer group says the companies took advantage of the Average Wholesale Price formula (AWP) to inflate reimbursements from Medicare for administered drugs and procedures that physicians perform personally, such as chemotherapy. The case is In Re: Pharmaceutical Industry Average Wholesale Price Litigation, 01cv12257, U.S. District Court for the District of Massachusetts.
