San Francisco, CA: HauteLook Inc and Nordstrom Inc, are facing a consumer fraud class action alleging they mislead consumers regarding certain watches they sell.
Specifically, the lawsuit, filed by Vahdat Aghdasy, individually and for all others similarly situated, claims the defendants made false and misleading statements to customers by offering Rolex-brand watches for sale to the general public, when the watches were allegedly damaged, in poor condition, and/or contained inferior parts that were not made by Rolex.
The plaintiffs also allege the defendants misrepresent the value of the watches and mislead consumers into believing the watches are being sold at a significant discount. The suit states the defendants even provide photographs of the watches to consumers, but the photographs do not represent the actual watch that is being sold.
Further, the lawsuit claims that the defendants advertise that the watches are shipped from Rolex, but are allegedly shipped from various jewelry stores.
