A class action lawsuit has been certified against the District of Columbia, et. al. on behalf of a mandatory class of approximately 3,500 young people who were charged in Washington, DC with underage possession or consumption of alcohol between spring 1997 and this past summer. The suit alleges police and prosecutorial misconduct including false arrests and prosecutions, negligence and infliction of emotional distress. The suit asks that the DC police expunge the plaintiff's arrest records due to the fact that under District law, underage possession or consumption of alcohol is a civil, not criminal, offense.
