Carnival Cruise Lines Faces Class Action over Hot Tub Infections

- by

Boca Raton, FL: Carnival Cruise Lines is facing a proposed personal injury class action lawsuit over allegations by former passengers that they contracted skin rashes and disorders from bacteria in shipboard hot tubs.

Specifically, the lawsuit contends that passengers contracted cellulitis, staph and MRSA bacterial conditions on their legs. The named plaintiffs in the suit are two residents of the state of Georgia, Maria Osoriocano and Andrew Smith, passengers on the Carnival Fascination in May 2012, and Tab Lankford, of Ohio, who was a passenger on the Carnival Paradise in December 2011.

On June 18, US District Judge Cecilia Altonaga denied a motion by Carnival to dismiss the lawsuit.

Plaintiff are represented by John Fitzgerald Billera, of Boca Raton-based Billera Law, and Miami attorney Sean Michael McCleary.
