Expecting couples traditionally must wait 20 weeks for ultrasound to correctly determine the gender of the fetus. In 2005, Acu-Gen Biolab began manufacturing Baby Gender Mentors that claimed to be 99.9% accurate in detecting the gender of the fetus as early as five weeks from conception. The test costs $275, but came with a 200% money-back guarantee. The kit claims to detect both female and male fetus specific chromosomal DNA with unprecedented specificity and sensitivity. However, the company does not provide any specific studies or research. Still, parents were promised a refund if the Baby Gender Mentor test results were incorrect. In order to get a refund, a customer was required to wait until the baby was born and provide a valid copy of the child's birth certificate. However, when parents with incorrect test results tried to get a refund, Acu-Gen Biolab refused to provide a refund and allegedly changed the terms of the refund policy. Parents have filed a class action lawsuit claiming Acu-Gen Biolab altered its refund policy and now requires women to deliver a live baby, provide an original birth certificate and provide a blood sample and fingerprints from their baby among other things.
