A class action lawsuit has been filed against American Express Publishing Corp. and Rodale Inc., on behalf of consumers. The suit s allege that the publishers sent unsolicited books to consumers, accompanied by an invoice and a letter explaining that if the customer kept the book, their credit card would be charged, and if they did not want to be charged they must return the books. The plaintiffs are claiming that this "wrongly forced an invalid and unconscionable purported 'contract'" on them. The suit is seeking declarations from the companies that the customers may keep the books as gifts, as unordered merchandise should constitute a gift for which the customer should not have to pay for or return.
