New York, NY: A $2.7 million settlement has been reached in the Coca-Cola Vitaminwater consumer fraud class action lawsuit, which alleges the company falsely marketed the sugar content of the drink. The lawsuit was filed six years ago.
Under the terms of the settlement, Coca-Cola Co, and Energy Brands Inc. will advertise on the labels that the products contain sweeteners. Further, the will replace the words "with sweeteners"on two panels of the product' labeling. Additionally, the beverage makers must state the amount of calories per bottle of the product on the product' main display panel and include the statement, "excellent source [of certain nutrients,]"on the product' labeling.
If approved, the settlement also cites a number of statements the defendants can no longer use to market Vitaminwater, including "vitamins + water = all you need"and "made for the center for responsible hydration,"according to the motion.
The parties are also seeking to certify two settlement subclasses which are all New York residents who purchased Vitaminwater in New York at any time from Janauar 20, 2003 to the notice date and all California residents who purchased Vitaminwater in California at any time from Jan. 15, 20015 to the notice date.
According to the terms of the agreement, each of the class representatives will be awarded $5,000.
The cases are Batsheva Ackerman et al. v. Coca-Cola Co. et al., case number 1:11-md-02215, and Juliana Ford v. The Coca-Cola Co. et al., case number 1:09-cv-00395, in the U.S. District Court for the Eastern District of New York.

Thought I had finally found a water with vitamins not loaded with sugar have drank it for months am very disappointed to find out the contents were misleading as stated.

I've spent more money on these drinks than you can imagine..Lots of money and mainly because I thought they were one of the more healthier drinks to purchase, and also because each flavor stated to help with one thing or another, such as more energy, etc..Finally just stopped buying them when the facts stated on the bottle didnt live up to the statements..I now feel ripped off by Vitamin Water..I don't buy them anymore I can tell you that!

I have always purchased these for myself and my oldest two kids. We always drank them rather then offers because it said it was healthy. I had no idea I was consuming crap loads of sugar and definitely wouldn't have given to the kids if I had known.

Was surprised to see this article as I am and have been drinker of this product for years. Always wondered about claims but worked outside in construction and thought was better than other brands. Slight'y worried about claim and as getting older trying to pay better attention to health.

I purchased this water for a long period of time. I would get it at a popular drug store, then i notice they dis continue it. I had no idea it had that much sugar in it. I drank it because it said it was healthy for you.

I drank this for a long period of time, thinking it was healthy vitamin water, it made me gain wait, and was thirsty all of the time and could only really quench my thirst with more Vitamin water, it is definitely not healthy.
